Welcome to the Adventist Peace Fellowship (“APF”) website. PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING THIS SITE OR ANY OTHER WEBSITES AFFILIATED WITH THE APF ORGANIZATION. YOUR USE OF THIS SITE SIGNIFIES YOUR AGREEMENT TO THESE TERMS OF USE. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE ANY APF SITE.
1. Ownership: APF is the copyright owner of all APF sites. Any and all use of APF Content should be in accordance with fair use principles under copyright law. You may not use any images from the APF site, including the APF logo, without first securing written permission from APF.
2. User Content: Some services or features on APF sites allow you to post messages, comments, or other material (collectively, “User Content”). You are solely responsible for any and all User Content you post to any APF site. We reserve the right, but not the responsibility, to: delete, remove and/or refuse to post any User Content, without notice, for any or no reason; and to share with third parties User Content, including personally identifiable information, when we believe in good faith that such identification or disclosure will help to serve compliance with criminal or civil law. You are responsible for creating backup copies of any User Content you post to APF sites. By posting User Content to any APF site, you automatically grant, and you represent and warrant that you have the right to grant, to APF an irrevocable, perpetual right to use, copy, publicly perform, display, translate, excerpt (in whole or in part), and distribute such User Content for any purpose. When you post User Content, you represent and warrant that the User Content and your communication thereof conforms to the APF Rules of Conduct (set forth below) and other requirements of these Terms of Use. You are and shall remain solely responsible for all User Content posted on the Sites under your username or otherwise by you in any Public Forum and for the consequences of submitting and posting the same. We have no duty to monitor any Public Forum, but reserve the right to do so at any time for any or no reason. You acknowledge that your posting of any User Content in a Public Forum is at your own risk. We are not responsible for, and do not endorse, the opinions, advice, or recommendations posted or sent by users in any Public Forum and we specifically disclaim any and all liability in connection therewith.
3. Rules of Conduct: The following Rules of Conduct apply to all APF sites. By using any APF site, you agree that you will not post any User Content nor engage in any activity that:
(a) is defamatory, abusive, threatening, or an invasion of the right to privacy of another person;
(b) is bigoted, hateful, violent, sexually explicit, or racially or otherwise offensive or potentially harmful to another person or persons;
(c) infringes or violates any right of a third party including copyright, patent, trademark, or contractual rights; or right of privacy (such as by distributing another person’s personal information without their express permission);
(d) is commercial, business-related or advertises or offers to sell any products, services or otherwise (whether or not for profit), or solicits others (including solicitations for contributions or donations);
(e) contains a virus or other harmful component, or otherwise tampers with, impairs or damages APF sites;
(f) does not generally pertain to the designated topic or theme of the relevant Public Forum;
(g) is antisocial, disruptive, or destructive, including "flaming," "spamming," "flooding," "trolling," and "griefing" as those terms are commonly understood and used on the Internet.
4. Claims of Copyright Infringement: If you believe in good faith that your copyrighted work has been used on an APF site without authorization in a way that constitutes copyright infringement, please contact the APF using the contact form provided on this website with the following information:
(a) the copyrighted work claimed to have been infringed that is requested to be removed;
(b) your name, address, telephone number, and e-mail address;
(c) a statement that you have a good-faith belief that the use of the copyrighted work is not authorized by the copyright owner, its agent, or the law;
(d) a statement, under penalty of perjury (United States law imposes strong penalties for falsely submitting a notice of copyright infringement), that you are authorized to act on behalf of the owner of an exclusive copyright right that is allegedly infringed.
5. Member Accounts: Some services or features on APF sites permit or require you to create a membership account to participate or gain access. You agree to provide true, accurate, current and complete information about yourself as prompted by the APF registration processes. You consent for APF to display your name and your state or country or vocation or affiliation, upon your completion of membership forms, on APF sites. You shall not impersonate any person or entity or misrepresent your identity or affiliation with any person or entity, including using another person's username, password or other account information, or another person's name, likeness, voice, image or photograph. You also agree to promptly notify APF of any unauthorized use of your username, password, other account information, or any other breach of security that you become aware of on any APF site.
6. Links: The APF site contains links to other sites beyond our control, such as organizations and content partners. We are not responsible for such sites, including any content on such sites. Unless specifically stated on the APF site, we do not, directly or indirectly, imply any approval, association, sponsorship, endorsement, with any linked site.
7. Disclaimers: UNDER NO CIRCUMSTANCES SHALL THE APF, ITS OFFICERS, BOARD MEMBERS, OR AFFILIATES BE LIABLE TO YOU OR ANY OTHER PERSON OR ENTITY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES INCLUDING LOST PROFITS, PERSONAL INJURY (INCLUDING DEATH) AND PROPERTY DAMAGE OF ANY NATURE WHATSOEVER, THAT RESULT FROM (A) THE USE OF, OR THE INABILITY TO USE, ANY SITE OR CONTENT, OR (B) THE CONDUCT OR ACTIONS, WHETHER ONLINE OR OFFLINE, OF ANY USER OF A SITE OR ANY OTHER PERSON OR ENTITY, EVEN IF APF HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE APF MAY TERMINATE YOUR FURTHER ACCESS TO SITES OR CHANGE THE SITES OR DELETE CONTENT OR FEATURES IN ANY WAY, AT ANY TIME AND FOR ANY REASON OR NO REASON. THE LIMITATIONS, EXCLUSIONS AND DISCLAIMERS IN THIS SECTION AND ELSEWHERE IN THESE TERMS OF USE APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
8. Indemnification: You are responsible for maintaining the confidentiality of your username(s), password(s), and your account(s), as well as all activities that occur under your account(s). You hereby agree to indemnify, defend, and hold APF and its officers and board harmless from and against any and all losses, damages, liabilities and costs (including settlement costs and any legal or other fees) incurred by the Indemnified Parties in connection with any claim arising out of any breach by you of these Terms of Use or claims arising from your use of the APF sites and/or your account(s). You shall use your best efforts to cooperate with APF in the defense of any claim. APF reserves the right to employ separate counsel and assume the exclusive defense and control of any matter otherwise subject to indemnification by you.
9. Governing Law and Jurisdiction: These Terms of Use shall be governed by and construed in accordance with the laws of the State of Maryland and the laws of the United States, without regard to any principles of conflicts of laws, You hereby consent to the personal jurisdiction of the state and federal courts located in Maryland for the purposes of litigating any action under these Terms of Use. Those who choose to access a Site do so on their own initiative and are responsible for compliance with all applicable laws including any applicable local laws.
10. Amendments: APF may amend these Terms of Use at any time, including by modification, deletion and/or addition of any portion of these Terms of Use. If APF makes a material amendment to these Terms of Use, APF will notify you of such amendment by sending you an e-mail at the last e-mail address that you provided us, and/or by posting notice of such amendment on the APF sites covered by these Terms of Use. Any such amendment to these Terms of Use will be effective thirty (30) calendar days following either APFs e-mail notice to you or posting of notice of the changes on the sites. In the event that the last e-mail address that you have provided APF is not valid, or for any other reason is not capable of delivering to you the notice described above, APF’s dispatch of the e-mail containing such notice will nonetheless constitute effective notice of any amendment described in the notice.
